
POTTER COUNTY -- Potter County Auditor Kerry Hood is being sued.
It was the main topic at today's commissioners court meeting.
Allison, Bass and Associates out of Austin filed the suit Thursday.
The firm claims the auditor has not paid them for legal fees racked up during an investigation of the road and bridge department.
That's when the commissioners court voted in a split vote to hire the firm.
An Amarillo Attorney representing the firm wouldn't go on camera.
But he says the auditor has not paid them, and they want their money.
The firm is suing for about twelve thousand dollars in unpaid legal fees.
A cost taxpayers may have to swallow.
"If there is a settlement and the county pays the settlement, that is if the court direct or approves a settlement then yeah that would come out of county funds," says Scott Brumley the county attorney.
Brumley says the commission is split on whether to pay this money.
He also says a visiting judge probably will hear the case.
A court date has not been set yet.
