Sunday Stabbing in Clovis on 1800 Block of Debra Street

CLOVIS --  65-year-old Phillip Montoya was arrested Sunday for Felony Aggravated Battery With a Deadly Weapon, Felony Child Abuse and Resisting and Evading Arrest. 
Clovis Police Officers were sent to the 1800 block of Debra Street Sunday afternoon on a report of a stabbing.

When officers arrived, they found a 43-year-old victim in the back yard bleeding from the chest and unconscious from apparent stab wounds.    
 
Two witnesses at the scene that live at the residence identified Phillip Montoya as the person that battered and stabbed the victim. According to the witnesses, Montoya and the victim were constructing a brick pillar in the back yard and began to argue. An argument had already been broken up once by a family member when a 4 year-old came in the house to tell that the two men were fighting again. A few minutes later another argument started between Lopez and Montoya escalated when Montoya pulled a box cutter and cut Lopez in the chest area and the two fought on the ground. The four-year old was witness to this and near the men as the fight took place. A family member pulled Montoya off of Lopez and took the box cutter from Montoya and tossed it over a fence. When Clovis Police Officers arrived at the scene Montoya took off running from Officers and was quickly apprehended and placed under arrest. 
Montoya is being held on bond at the Curry County Adult Detention Center.
 
The victim has regained consciousness and is in stable condition and due to be released from the hospital in Lubbock.
